Abstract

The Investigator Organization for Supporting the Rule of Law and Democracy (IOL), in its second issue of the newsletter, provides an analytical and assessment-based overview of the most significant developments and issues related to the rule of law, justice, constitutional affairs, and judicial institutions in Iraq and the Kurdistan Region.

This issue highlights the transition of the rule of law process from the strategic development phase to practical implementation, particularly within the framework of the National Strategy to Strengthen the Rule of Law (2025–2029) and the steps taken by relevant institutions to implement its main and sub-implementation plans. Within this process, the role of IOL in cooperation with the Ministry of Justice and its engagement in developing and preparing implementation plans is highlighted.

The newsletter also provides an overview of IOL’s coordination and cooperation with the World Justice Project (WJP) to support Iraq’s preparation for inclusion in the World Justice Project Rule of Law Index. This effort is part of promoting the use of international standards and mechanisms to assess the status of the rule of law in Iraq and is linked to the National Strategy to Strengthen the Rule of Law (2025–2029).

At the same time, the issue highlights the Maff Network as an institutional initiative aimed at bringing together and strengthening civil society efforts in the legal field, monitoring the implementation of laws, supporting legal reform, and producing reports and evidence-based assessments aligned with international standards.

In another section, the newsletter presents a strategic comparison with Kosovo’s experience in implementing its rule of law strategy, emphasizing that the effectiveness of rule of law strategies depends not only on developing a comprehensive strategy, but also on sustained political commitment, realistic planning, adequate funding, institutional coordination, and continuous oversight.

The newsletter also analytically examines some of the most significant constitutional and institutional challenges facing Iraq and the Kurdistan Region, including the post-election situation of the Kurdistan Region Parliament, the absence of a constitution in the Region, the need to establish a constitutional court, as well as the constitutional issue surrounding the definition of the “Largest Parliamentary Bloc” and its implications for the process of government formation.

In this regard, the second issue of the “Status of the Rule of Law in Iraq and the Kurdistan Region” Newsletter is not merely an informational publication; it serves as an analytical resource for monitoring, assessing, and understanding legal, constitutional, and institutional developments in Iraq and the Kurdistan Region. It also highlights IOL’s role in supporting legal reform, strengthening justice, enhancing institutional capacity, and advancing the rule of law through national coordination and internationally recognized standards.
